Ensil provides a limited repair warranty on work performed at the time of shipping from its facilities to the customer for a period of 120 days on parts and labor. This limited repair warranty is non-transferable, and does not cover software or firmware embedded in circuit boards or damages resulting from shipping or packaging, electro static discharge, lightning, abuse, installation or tampering by unauthorized persons. Ensil’s limited warranty covers only the work performed by Ensil on the original defect. Ensil’s obligations under this warranty are limited to the repair and service by Ensil that proves to be defective, which in no event shall exceed the amount customer paid to Ensil for the services. Ensil reserves the right to inspect the product for which warranty claims are made. Ensil makes no other warranties or promises, expressed or implied, by operation of law or otherwise, including, without limitation, any warranties of non-infringement , merchantability or fitness for a particular purpose or use, or any expressed or implied warranties of contract terms or amendments arising out of course of performance to the maximum extent permitted by applicable law, in no event shall Ensil be liable for any indirect, special, incidental or consequential damages arising from repair work performed by Ensil on these products.
